6. Accident, Injury, Disability or Death Clause

  • The employee clearly understands and agrees that all work assigned by Nirmexa CleanCare is offered only after basic explanation, and execution of such work is purely at the employee’s own willingness and consent.

  • The company does not force, pressure, or compel any employee (full-time, part-time, contractual, or temporary) to perform any task that involves risk to life, health, or safety.

  • Before starting any work, the employee must personally inspect, assess, and evaluate the work location, tools, height, electrical connections, water level, chemicals, or any other risk factors.

  • If the employee feels that any work is unsafe or risky, the employee has the absolute right to refuse such work, and the company shall not take any disciplinary action for such refusal.

  • If the employee voluntarily chooses to perform the work despite known or perceived risks, then the entire responsibility and liability shall rest solely with the employee.

  • In the event of any accident, injury, permanent disability, partial disability, or death occurring during work, travel for work, or at the client’s premises:

    • The company shall not be responsible or liable, directly or indirectly, financially, legally, morally, or otherwise.

    • The employee or the employee’s legal heirs shall not make any claim against Nirmexa CleanCare, its owner(s), partners, managers, or supervisors.

  • The employee confirms that personal safety precautions, protective measures, and self-care are entirely the employee’s responsibility.

  • The employee acknowledges that the company has not promised or guaranteed any insurance coverage, compensation, medical expenses, or ex-gratia payment unless separately documented in writing.

  • This clause shall be applicable equally to full-time, part-time, daily-wage, temporary, and contractual employees.

7. Governing Law & Jurisdiction

These Terms and Conditions shall be governed and interpreted in accordance with the laws of India, and any disputes shall be subject to the exclusive jurisdiction of Indian courts.
